Terms of Sale

1. Seller. These terms apply when you buy from Tintame AB (under formation), org. no. [...], [address], Sweden, [email protected], [phone, or: we do not offer telephone support] ("Tintame", "we"). They apply to purchases by consumers. If you buy in the course of a business, section 12 applies.

2. The order and the contract. You place an order by completing checkout. The steps are: choose items and add them to the cart, go to checkout, enter your delivery details, review the order, and click the button marked "Pay" (an order with an obligation to pay). You can check and correct everything in the cart and at checkout before you pay. The contract is formed when we send the order confirmation by email. The confirmation contains these terms, the withdrawal information and the model withdrawal form, so you can keep them; we do not otherwise file a copy of the contract for you. The contract language is English. We may decline an order, for example if an item cannot be produced or delivered to your country, and will then refund any payment in full.

3. The products. Our prints are reproductions of works in the public domain, printed to order on the paper and in the frame stated on the product page. Colours on screen can differ slightly from the printed result. Each print shows the whole artwork; if its proportions differ from the paper, the difference is left as a white border. Frame colours on the site are illustrations.

4. Prices, taxes and payment. Prices are shown in the currency stated at checkout and include delivery. The total at checkout is the final price for: the EU (VAT at the applicable rate included), the UK (UK VAT included; orders for the UK are printed in the UK, so no import charges arise), and Norway where checkout states that Norwegian VAT is included (VOEC). For other destinations, delivery is Delivered At Place (DAP): you are the importer, and import VAT, duties or carrier fees may be charged to you on delivery, unless checkout states that duties are included (DDP). In the US we collect sales tax where the law requires it. Payment is taken by Stripe when you order. We do not see or store your card details.

5. Delivery. Each item is made to order by our print partner and shipped from the production site nearest to you. Estimated delivery times are shown at checkout; unless another date is agreed, we deliver within 30 days of the order. If delivery is more than 30 days late, or later than a date we agreed, you may cancel and get a full refund, without affecting your other rights.

6. Right of withdrawal (standard items). You may withdraw from the purchase within 14 days of the day you, or someone you name, receive the item, without giving a reason. This applies to buyers in the EU, the EEA and the UK by law, and we offer the same right to buyers everywhere else. You may also withdraw before the item is delivered. We never charge a cancellation or handling fee for standard items; you only pay the cost of returning the item, and for any loss in value caused by handling it more than needed to examine it. The details and a model form are in our withdrawal information.

7. Made-to-measure items. Some items may be made to your own specifications, for example printed in a size calculated from measurements of your wall. Such items are marked "made to measure" on the product page and at checkout, next to the order button. Choosing one of our standard sizes or frames does not make an item made to measure. There is no right of withdrawal for made-to-measure items, because they are made to your specifications (Swedish Distance Contracts Act 2 ch. 11 § 3; EU Directive 2011/83/EU art. 16(c)). You may still cancel before the item has been delivered. If production has not started, you pay nothing. If production has started, we may charge only the reasonable costs we have actually incurred and cannot avoid or recover, such as printing, framing and non-refundable shipping, and never more than 50% of the price (Swedish Consumer Sales Act 7 ch. 7 §). We itemise the costs in writing before we charge them and refund the rest.

8. Faulty or damaged goods. If an item arrives damaged, is faulty or is not as described, contact us with a photo. We will replace it or refund you, at no cost to you. You keep all rights under the consumer law that applies to you. Under Swedish law you may complain about a defect for three years after delivery. Tell us within a reasonable time after you notice it; notice within two months is always in time.

9. Refunds. Refunds are made to the payment method you used, within 14 days of your withdrawal, cancellation or accepted complaint. For withdrawals we may wait until we have received the item back or proof that you have sent it.

10. Liability. We are responsible for our products and for losses that are a foreseeable result of our breach of these terms. Nothing in these terms limits liability that cannot be limited by law.

11. Complaints and disputes. Contact us first at [email protected]. Buyers in Sweden may refer a dispute to the National Board for Consumer Disputes (ARN, Box 174, 101 23 Stockholm, arn.se), and we will take part. Buyers in the UK: if we cannot resolve a complaint, we will tell you whether we agree to use an ADR body and give you its website. Buyers in other EU countries can get help from the European Consumer Centre in their country. These terms are governed by Swedish law. If you are a consumer, this does not take away the protection of the mandatory law of the country where you live, and you may bring a claim in the courts of that country (Rome I art. 6; Brussels I bis arts. 17–19; UK equivalents).

12. Business buyers. For buyers acting in the course of a business, sections 6 and 7 on withdrawal do not apply, liability is limited to the price of the order, the Swedish Consumer Sales Act does not apply, and disputes are settled by the Stockholm District Court under Swedish law.

13. Changes. The terms in force when you order apply to your order. We may update these terms for future orders.
